Terms of service

These terms are the agreement between you and LastLit, run by [TO CONFIRM: legal name of the company or person] ("we", "us"). They cover the LastLit app on iPhone, Android and app.lastlit.com, and this website. By creating an account or joining the waitlist, you agree to them. Please read them with our Privacy policy and Community rules, which are part of these terms.
1. Who can use LastLit
You must be 18 or over. When you sign up you give your date of birth, and we turn away anyone under 18. Giving a false date of birth breaks these terms.
2. Your account
- Use your real date of birth and an email address you can read.
- Keep your password to yourself. You're responsible for what happens on your account. If you think someone else has used it, change your password in Settings: that signs out every other device.
- Usernames are 3 to 20 lowercase letters, numbers, dots and underscores. Some names are reserved, and we can refuse a name that impersonates someone or breaks our Community rules.
- Joining the waitlist holds a username for the email you joined with. After launch, the hold lasts 30 days, then the name is free for anyone.
- You can delete your account at any time in Settings → Delete account. What that deletes is explained in the Privacy policy.
3. Your photos
You own your photos. By sharing one, you give us a limited, non-exclusive, worldwide, royalty-free licence to:
- store it, copy it and adapt it as the service needs: shrinking it, removing its metadata, making the greyscale version shown once it has faded, and running the automatic safety check;
- show it to people using LastLit while it's lit, and above every feed while it holds the spotlight;
- show it to you on your Me screen after it fades;
- keep it privately, if a moderator removes it, for the period described in the Privacy policy.
This licence lasts until the photo is deleted, which happens when you delete your account (except a removed photo, which is kept privately for that period first). We don't use your photos to advertise LastLit, and we don't sell them or license them to anyone else.
Only share photos you took or have the right to share, and that follow the Community rules. You're responsible for what you share.
4. How photos are kept or faded
This is the game, so it's worth being clear:
- A new photo is lit for 3 hours. People who see it vote Keep or Fade.
- If more people Keep it than Fade it when its time is up, it's kept and gets another window, one hour longer each time: 4 hours, then 5, then 6, and so on.
- If more people Fade it, if it's a tie, or if nobody votes, it fades, and that can't be undone. Once a photo has faded, it no longer appears to anyone else.
- You can have one lit photo at a time.
- Deleting a photo during its window counts as faded.
- The photo kept the longest, out of those kept at least once, is in the spotlight: it appears above everyone's feed until it fades.
- A photo can be hidden while a moderator reviews it (see the Community rules). Time spent hidden doesn't count against its window.
The votes are strangers' opinions. We don't promise that any photo will be kept, or for how long.
5. Captions and spotlight notes
- Captions can't contain links, email addresses, phone numbers or blocked words.
- When your photo holds the spotlight, you can add a note of up to 40 characters, with one optional
https://link. A moderator reads every note before it appears, and can reject it. An approved note is shown with your username and the link's web address, and only while your photo holds the spotlight. - Don't use a note to send people somewhere harmful, misleading or illegal.
6. What we can do
To keep LastLit safe and working, we can:
- turn away a photo our automatic check flags, before anyone sees it;
- hide a photo while it's reviewed, and remove photos, captions or notes that break these terms or the Community rules;
- refuse a username, and change or remove one that breaks these terms; [TO CONFIRM: there's no tool for changing someone's username yet.]
- suspend an account (it can still be used to look around, but not to share, vote or add notes), or close it (it's signed out everywhere, can't sign in again, and its lit photo is removed), if it breaks these terms or the law requires it.
A removed photo fades, and you'll get a notification saying it was removed for breaking the Community rules. If you think we got it wrong, email support@lastlit.com and we'll look again.
7. The service as it is
LastLit is a young product. We provide it as it is and as available. We don't promise it will always be online, fast or free of errors, that a vote will always be counted, or that a photo will always be kept or shown to a particular number of people. We may change, pause or stop features, or LastLit as a whole.
8. Limitation of liability
To the fullest extent the law allows:
- we aren't liable for indirect or consequential loss, or for lost profits, data, goodwill or opportunities;
- we aren't responsible for what other people share, vote or write;
- our total liability to you for any claim is limited to [TO CONFIRM: the cap, for example the greater of what you paid us in the last 12 months and a fixed amount].
Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud. If you're a consumer, you keep the rights the law gives you.
9. Ending this agreement
You can stop using LastLit and delete your account at any time. We can end this agreement or close your account if you break these terms, if the law requires it, or if we stop running LastLit. If we stop running LastLit, we'll give notice first where we reasonably can. 10. Changes to these terms
We may update these terms as LastLit changes. We'll post the new version here and change the date at the top. If you keep using LastLit after a change takes effect, the new terms apply. 11. Governing law
These terms are governed by the law of [TO CONFIRM: country/jurisdiction], and disputes go to the courts of [TO CONFIRM: country/jurisdiction]. If you live elsewhere as a consumer, you may also have the right to bring a claim where you live.
